<p>Problem statement. The spread of artificial intelligence and automated decision-making systems raises the question whether the ‘digital state’ is a newhistorical type of state or merely a technologically transformed mode of exercising public power. A historical review—from rational-legal bureaucracy and cybernetics to the Soviet OGAS project—reveals continuity in the state’s effort to translate social reality into data, feedback loops and governing algorithms. Purpose. The article identifies the historical and theoretical patterns of algorithmisation of public power and formulates legal limits for the use of algorithms in legally significant decisions. Methods. Dialectical, historical-legal, formal-legal, comparative-legal and systemfunctional methods, as well as legal modelling, are used. Results. Algorithmic public power is substantiated not as an independent type of state but as a special technological regime for performing state functions. The author proposes a ‘constitutionally governed algorithm’ model comprising legality of purpose, data traceability, explainability, contestability, meaningful human control and the non-delegable responsibility of the public authority. Normatively defined discretion must not be replaced by hidden software discretion.</p>
<kwd-group xml:lang="ru"><kwd>алгоритмическая публичная власть</kwd><kwd>цифровое государство</kwd><kwd>теория государ ства</kwd><kwd>история государства и права</kwd><kwd>ОГАС</kwd><kwd>искусственный интеллект</kwd><kwd>алгоритмическое управление</kwd><kwd>цифровой суверенитет</kwd><kwd>объяснимость</kwd><kwd>право на обжалование</kwd></kwd-group><kwd-group xml:lang="en"><kwd>digital sovereignty</kwd><kwd>explainability</kwd><kwd>right to appeal</kwd><kwd>artificial intelligence</kwd><kwd>algorithmic governance</kwd><kwd>algorithmic public power</kwd><kwd>digital state</kwd><kwd>theory of the state</kwd><kwd>history of state and law</kwd><kwd>OGAS</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Конституция Российской Федерации (при нята всенародным голосованием 12 декабря 1993 г.
